California's Proposition 65 Act

California Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, is a significant regulation enacted by the State of California aimed at protecting residents from exposure to chemicals known to cause cancer, birth defects, or other reproductive harm.

This law requires businesses to provide clear and reasonable warnings before exposing individuals in California to certain chemicals listed by the state’s Office of Environmental Health Hazard Assessment (OEHHA). The list, which is updated at least once annually, includes over 900 chemicals found in consumer products, industrial chemicals, dyes, solvents, metals, and plastics.

Proposition 65 and Beauty Instruments

Although beauty tools like scissors, tweezers, and nail clippers are typically low-risk in terms of exposure, compliance with Proposition 65 is vital for companies selling or distributing in California. Many beauty and personal care products may contain trace levels of listed substances through:

  • Surface coatings or plating (e.g., nickel, cadmium, chromium VI)
  • Plastic or rubber components (e.g., phthalates)
  • Packaging inks or adhesives
  • Cleaning or anti-rust residues used during manufacturing

Prowa Beauty Instruments ensures that our products undergo rigorous material screening and chemical analysis to:

  • Avoid or limit the use of any listed substances
  • Comply with RoHS, REACH, and Proposition 65 standards
  • Provide labeling only when necessary under Californian law

Labeling Requirement Under Proposition 65

If a product contains one or more listed substances above the Safe Harbor Levels, companies must affix a clear warning label, such as:

⚠️ WARNING: This product can expose you to chemicals including [name of chemical], which is known to the State of California to cause cancer and birth defects or other reproductive harm. For more information, visit www.P65Warnings.ca.gov.

Failure to provide appropriate warnings can result in civil penalties of up to $2,500 per violation per day, and private lawsuits are commonly filed by consumer advocacy groups.
